Individual case record
Overview
On 29 June 2026, S.A. Jamendo filed a Complaint in the US District Court for the District of Massachusetts against Suno Inc. Jamendo runs Jamendo.com an online platform of music by independent artists. The Plaintiff seeks damages for copyright infringement and breach of contract alleging that Suno unlawfully copied and ingested the Jamendo Database and MTG-Jamendo Dataset to develop and train its AI audio generation platform, including its Bark text-to-audio model, without authorisation.
The Complaint describes that Jamendo holds exclusive commercial exploitation rights to numerous musical works and sound recordings in its database. In Spring 2023, Suno publicly released Bark as an open-source model, accompanied by technical documentation on GitHub and Hugging Face explicitly identifying Jamendo as a training source. Suno's use was commercial in nature and violated the applicable Creative Commons Attribution-NonCommercial-ShareAlike 4.0 license, which expressly prohibits commercial use without permission.
The Plaintiff brings claims for copyright infringement under 17 U.S.C. ss. 101 et seq., breach of contract regarding the CC BY-NC-SA 4.0 license and terms of use, unjust enrichment, and unfair and deceptive acts under Massachusetts law.
