Overview
On 21 November 2025, Raza Khan filed a proposed class action against Figma, Inc., alleging that the company unlawfully used customers’ intellectual property to train its generative AI models in connection with the rollout of new AI-enabled products and its initial public offering.
According to the complaint, Figma historically assured users through its Terms of Service that they retained ownership of all content uploaded to or created on the platform. The Claimant alleges that, in mid-2024, Figma revised its terms and implemented a “Content Training” setting that was automatically enabled by default for certain subscription tiers, including Starter and Professional plans. It is alleged that Figma used customer design files and related materials to train its AI systems without obtaining informed, opt-in consent, and without contractual authorisation. Enterprise-tier customers were not automatically opted in.
The Complaint contends that Figma’s AI tools, including features launched under “Figma AI” and related products, were trained on proprietary customer content, including confidential designs, software code, and other commercially sensitive materials. The Claimant alleges that this conduct breached Figma’s contractual commitments, misappropriated trade secrets under California and federal law, and violated California’s Unfair Competition Law and related statutory provisions. The action also asserts claims under the California Computer Data Access and Fraud Act and the federal Stored Communications Act.
The proposed class comprises U.S.-based subscribers whose intellectual property was allegedly used to train Figma’s AI models. The Claimant seeks injunctive relief to prohibit further use of AI systems trained on customer content, together with other relief.
