Anthony Justice and 5th Wheel Records, Inc. v. Uncharted Labs, Inc. d/b/a Udio.com is a class action brought by independent musicians alleging that Udio’s AI music generator was trained on copyrighted songs without licence or consent, in violation of the Copyright Act (17 U.S.C. § 106). Plaintiffs claim Udio copied and reproduced their songs (Count I) and that its model creates near-exact replicas or derivative works of those recordings (Count II).
They argue Udio’s conduct was knowing and willful, and that fair use does not apply to such commercial exploitation. The complaint cites the U.S. Copyright Office’s May 2025 AI Report, which found that using copyrighted expressive works to generate competing outputs likely infringes reproduction and derivative rights. Plaintiffs seek damages and injunctive relief on behalf of all independent artists whose songs were misappropriated to train Udio’s AI model.
