Two authors, Grady Hendrix and Jennifer Roberson, have launched a proposed class action against Apple Inc. in the United States District Court for the Northern District of California, alleging that Apple’s OpenELM large language models were trained on copyrighted books without consent, attribution, or remuneration. The claimants contend that Apple utilised the Books3 dataset, a known repository of pirated literary works, and possibly other so-called “shadow libraries”, together with its proprietary Applebot web crawler, to scrape and ingest protected content in breach of copyright law.
Hendrix, a New York-based horror novelist, and Roberson, an Arizona-based fantasy author with more than 120 published titles, seek to represent a nationwide class of authors whose works were allegedly copied to train Apple’s AI systems.
