Overview
On 26 March 2026, Austin Beaulier, a professional 3D artist and photogrammetry specialist, filed a class action against Roblox Corporation in the United States District Court for the Northern District of California, San Francisco Division, alleging that his Creative Commons-licensed 3D models were used to train the Cube 3D generative system without preservation of attribution or licensing metadata. T
he Complaint alleges that Roblox drew training assets from the Objaverse-XL dataset, which indexes more than ten million models sourced from repositories including Sketchfab, Thingiverse and Polycam, and that its preprocessing pipeline stripped creator identity, Creative Commons designations and Sketchfab "NoAI" tags from those works before ingestion. Claims are brought under the Digital Millennium Copyright Act for removal of copyright management information (17 U.S.C. § 1202(b)(1)) and for distribution or use of works knowing that such information has been removed (17 U.S.C. § 1202(b)(3)). The Plaintiff seeks class certification, statutory or actual damages under 17 U.S.C. § 1203, injunctive relief requiring preservation of copyright management information in future training datasets, and attorneys' fees.
