On 22 October 2025, author Tasha Alexander filed a class action complaint alleging that Apple unlawfully used her copyrighted literary works (and the works of others) to train its OpenELM and FLM models powering Apple Intelligence. The complaint claims Apple copied pirated materials from sites like LibGen and Z-Library, without consent or license, integrating them into products across iOS 18–26, macOS Sequoia to Tahoe, and Vision Pro. Plaintiffs allege ongoing copyright infringement under 17 U.S.C. § 101 et seq., arguing that Apple’s embedding of their works into its AI ecosystem caused irreversible harm through unauthorised reproduction, distribution, and commercial exploitation of their creative works.
